You can check who has used the image to ensure that a competitor is not using the same image you licensed. Rights-Protected Licenses are based on the usage of the image, while with Royalty Free, you purchase a general license according to image resolution. There are also differences in quality and content. High quality Rights-Protected Images represent a wider variety of content and subject matter.

Should you use Rights-Protected Images or Royalty Free?

At iKjeld.com there is not much of a choice really...; iKjeld offers mainly Rights-Protected images.

But if you are considering using Royalty Free images ask yourself if it is important for you to know the sales history of an image. Next consider if you need exclusivity. You may not require an exclusive license, yet it is important to realize that Royalty Free images are more widely distributed and as a result less unique. In other words you get a more unique image, even when buying non-exclusive rights for a Rights-Protected Image.

Purchasing Royalty Free Images:

After you have purchased a Royalty Free Image from iKjeld.com, you can use it almost any way you want, as often as you want... with a few important exceptions.

Please review the licensing agreement below. It explains what these exceptions are. They include:

* Reproduction rights are non-transferrable: You may not sell, rent, loan, give, sublicense, or otherwise transfer the Image or the right to reproduce the Image to someone else.

* No "sensitive issue" uses allowed. Please read the agreement: use of these images in connection with sex, contraception, mental or physical abuse, domestic violence, physical or mental challenges, AIDS, substance abuse, alcohol, tobacco, cancer, other potential sensitive issues or possible disparagement or defamation of character or product is expressly forbidden without the prior express written consent of iKjeld.com.

ROYALTY-FREE LICENSE AGREEMENT

THIS IS A LEGAL AGREEMENT BETWEEN YOU AND IKJELD.COM (IKC) PERTAINING TO ROYALTY FREE IMAGES ON THIS WEB SITE. PLEASE READ THIS AGREEMENT CAREFULLY BEFORE DOWNLOADING ANY IKC ROYALTY FREE IMAGE ("Image"). BY DOWNLOADING, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT.

1) COPYRIGHT.
All Images are copyrighted. IKC owns all rights to the Images. All rights not specifically granted to you by this Agreement are reserved. Your right to reproduce an Image is subject to the restrictions set forth in this agreement and is conditioned upon your full payment of the license fee prior to your reproduction of the Image.

2) REPRODUCTION RIGHTS GRANTED. By this Agreement, IKC grants to you a personal, non-exclusive, non-transferable right to reproduce a particular Image in one, and only one, of the following ways:

A) Print Usage: When licensing an image for Print Usage (50, 30 or 10 megabyte image file) you may incorporate the Image in a Print Reproduction such as: advertising, editorial, catalogs, brochures, reports, disposable packaging, book covers, and educational textbooks. The License for Print Usage includes the rights granted for Multimedia Usage under section "B" below.

B) Multimedia Usage:
When licensing an image for Multimedia Usage (2 megabyte image file) you may incorporate the Image in Non-Print Reproductions such as: web sites, broadcast video, multimedia presentations, and CD ROMs; provided that the image is incorporated into a design in such a fashion that it is clearly not intended to be downloaded or copied.

C) Free Comp Layout Usage: You may incorporate the 150K preview image file into a comprehensive layout for the purposes of presentation for approval or for planning only. In the event the 150K preview image file is of an adequate file size to incorporate into your project, a Print or Multimedia license must still be purchased.

(2) A Special Use License must be purchased when incorporating an image copyrighted by Visual Language into a resale product such as, but not limited to, covers of books, music and movie packaging, or greeting cards, posters, framed prints, stationery, apparel, and calendars.

3) OWNERSHIP. No ownership interest or copyright in any Image shall pass to you by the download of an Image or by the granting of the license to reproduce an Image.

4) NON-TRANSFERABLE. "Non-transferable," as used in section 2, means that the work you produce, incorporating the Image, must be for your own use, or for the use of your direct employer, client, or customer, who must be the end-user of your work. You may not sell, rent, loan, give, sublicense, or otherwise transfer to anyone the Image or the right to reproduce the Image (except insofar as it has been incorporated by you into one of the permitted uses enumerated in Section 2 of this Agreement), and nothing you produce shall grant or purport to grant to any third party a right to reproduce or duplicate the Image. You agree to take all commercially reasonable steps to prevent third parties from reproducing, duplicating, or distributing the Image.

5) Unlawful, Defamatory, Pornographic or Use of the Image in Connection with Sensitive Subject Matters is Prohibited. You are prohibited from using any Image (a) to directly or indirectly imply an endorsement or affiliation with individuals, products or entities that have not expressly authorized such usage; (b) to defame or disparage, directly or indirectly, any person, product or entity; (c) in connection with any potentially sensitive issue including, but not limited to, sex, reproduction rights, physical or mental challenges, aids or substance abuse; (d) for pornographic purposes.

6) INDEMNITY. You agree to indemnify and hold IKC harmless against any damages or liability of any kind arising from any reproduction of the Image other than reproductions specifically permitted by this Agreement.

7) WARRANTY. IKC MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. NEITHER IKC NOR ANY OF ITS DIRECTORS, OFFICERS, EMPLOYEES, PARTNERS, LICENSORS, OR AGENTS SHALL BE LIABLE FOR ANY DAMAGES, WHETHER DIRECT, INDIRECT, CONSEQUENTIAL OR INCIDENTAL, ARISING OUT OF THE USE OF, OR THE INABILITY TO USE, THE IMAGE. IKC'S LIABILITY, IF ANY, IS LIMITED TO THE AMOUNT YOU PAID AS A LICENSE FEE.

8) PAYMENT. Unless you pay by Credit Card, all Invoices are payable net thirty (30) days. A finance charge of 1.5% per month or the maximum interest permitted by law, whichever is less, will be applied on any balances unpaid after thirty (30) days.

9) CANCELLATION POLICY. There are no refunds or cancellations. You authorize IKC to charge you for the selection of Royalty Free Images and accept the terms stated within this License Agreement.

10)ADDITIONAL RIGHTS. ADDITIONAL RIGHTS MAY BE AVAILABLE. IF YOU ARE UNSURE OF YOUR RIGHTS UNDER THIS AGREEMENT, OR IF YOU WISH TO USE AN IMAGE IN A MANNER NOT PERMITTED UNDER THIS AGREEMENT, PLEASE CONTACT IKC BY TELEPHONE OR E-MAIL.

11)MISCELLANEOUS. This Agreement shall be governed by the laws of Japan, except for the Conflict of Laws Provision. You consent to the personal jurisdiction to the courts of Japan. Venue for any action respecting this Agreement, the Image, or reproduction or attempted reproduction of the Image, shall be in the city of Osaka.
